Rail worker hit by train awarded €300,000

A RETIRED Irish Rail worker who lost his leg in a work accident was awarded almost €300,000 in damages by the High Court yesterday.

The man had his left leg amputated from the knee down after he was hit by a reversing train at Heuston station on June 11, 2001.

Nicholas Dillon (67) had sued Iarnrod Eireann for negligence, breach of contract and damages.

He said he had been asked to check the last train for a piece of luggage that reportedly had been left behind at platform five. He was wearing a high-visibility, orange-coloured jacket when he crossed a railway line to reach the train.

But he was struck by a train reversing from the yard towards the platform and was knocked to the ground.

He also suffered a fractured and dislocated hip, a wound to the back of his head and damage to his right foot.

Obviously I am no expert but it sounds like he walked accross the rail without looking. How can a rail worker not see or hear a train coming?
