Refund time frame

Is there a set time frame in which IE have to respond to refund requests?

I put one in 3 weeks ago now for the chaos on Mar 13, but haven't ahd as much as an acknowledgement.

Though I saw something before in the customer charter, but can't find it now.

On a related note - are IE legally bound by the customer charter? Or is it just a sop to satisfy the DOT?

I sent in for a refund for a ticket that I hadn't used (missed the train, took the bus), it took about 3 months before the refund slip came through. I did get an apologetic letter with it, though, explaining that my refund form and ticket had been lost on someone's desk.

Must be a big desk, they managed to lose my last refund form as well, that said I had a photocopy for that contingency

Note to confuse matters stuff for Heuston based services bar Waterford should go to customer relations southern and western Heuston (703 4499), the forms in Heuston have that address the ones in Thurles and elsewhere don't. Thurles is the only station where the forms are actually on display

Years ago I was on a train that took over 5 hours from Dublin - Galway on Paddy's day. (I was living in Amsterdam at the time, and it had taken me less time to get from my front door there to Heuston, and that included changing planes in Heathrow).

I wrote a letter of complaint the following week (i.e. mid March). In late June, I got a reply advising me I could get a refund if I sent in the ticket I'd used, which needless to say had been binned months before..

That's service for ya!

I booked a return ticket from Brussels South to Ypres and then got the local bus to Mesen. The police had blocked the road into Mesen and I missed the return bus, which was terminating one stop from the terminus. I luckily got a lift back to Brussels.

Next day I went to Brussels South and asked for a refund. They told me I would have to go to the reclaim office in Ypres.

Ah, well when you have the King and Queen of Belgium, Queen Elizabeth and the Irish Preseident in town, you close the roads.

Colm Donoghue 17-04-2007 15:31

Ah yes it's great to live in a country where the people get to choose their head of state instead of the last head deciding...
oh wait....

The queen of Holland or Denmark apparently cycles to the shops herself.

Despite an e-mail a week ago telling me my claim would be processed immediately if I e-mailed my details, I've again heard nothing.

It's six weeks now, and this is beyond a joke.

Are IE subject to the small claims court?

Nope, Sales of Goods and Supply of Services Act 1980 clearly excludes transport undertakings
Quote:

39.—Subject to section 40, in every contract for the supply of a service where the supplier is acting in the course of a business, the following terms are implied—

( a ) that the supplier has the necessary skill to render the service,

( b ) that he will supply the service with due skill, care and diligence,

( c ) that, where materials are used, they will be sound and reasonably fit for the purpose for which they are required, and

( d ) that, where goods are supplied under the contract, they will be of merchantable quality within the meaning of section 14 (3) of the Act of 1893 (inserted by section 10 of this Act).

40.(6) Section 39 shall not apply to a contract for the carriage of passengers or goods by land, sea, air or inland waterway from one place to another within the State

That's a really strange exclusion.

MOH 03-05-2007 09:36

Thanks, I was afraid of that.

[edit] Hang on, does that mean IE:
- need not have "the necessary skill to render the service";
- don't have to "supply the service with due skill, care and diligence"; and
- need not have equipment that's "sound and reasonably fit for the purpose for which they are required"

Explains a lot

We could go to the high court get an injunction and shut them down.... Then again that won't make things any better

MOH 04-05-2007 16:15

Finally got my refund in the post this morning, exactly seven weeks after I handed the form in at Connolly.
